Personalized learning
Adaptive learning systems that adjust content and pace to the student's level. Risk classification depends on the extent to which the system determines what students learn and at what pace.
Proctoring
AI-driven surveillance software for online exams (facial recognition, behavior analysis, environment scanning). Intersects with biometric processing and student privacy.
Student analytics
Predictive models that identify which students are at risk of dropping out. High-risk when used for decisions about admission or academic progress (Annex III, point 3(a)).
Adaptive testing
AI systems that adjust the difficulty of test questions in real-time based on previous answers. Impact on assessment outcomes makes this potentially high-risk.
High-risk classification
The EU AI Act (Regulation 2024/1689) classifies the following educational applications as high-risk in Annex III:
Access to education and vocational training
Annex III, point 3(a)AI systems used to determine whether persons are admitted to or gain access to educational and vocational training institutions at all levels. This includes admission systems, selection algorithms and systems that assess academic progress.
Assessment of learning outcomes
Annex III, point 3(a)AI systems used for assessing learning outcomes, including automated grading of tests and determining the required level of education. The regulation emphasizes the impact on educational and professional opportunities.
Monitoring of behavior during tests
Annex III, point 3(a)AI systems for monitoring and detecting prohibited behavior of students during tests (proctoring). When biometric data is used, additional requirements apply.
Specific challenges
Data protection of minors
In primary and secondary education you work with data of minors. The GDPR sets extra requirements for processing data of children. The EU AI Act reinforces this: high-risk AI systems affecting minors must provide additional safeguards.
Fairness in assessment
Automated assessment systems can contain bias based on language, culture or socioeconomic background. The EU AI Act requires these systems to function fairly and non-discriminatorily (Article 10). In education, the impact on life chances is significant.
Digital divide
Not all students have equal access to technology. AI systems that require a certain device, internet speed or digital skills can reinforce inequality. The EU AI Act requires you to include this in your risk assessment.
Procurement and responsibility
Educational institutions often procure AI tools (proctoring, LMS, adaptive learning systems). As a deployer you are co-responsible. You must ask vendors the right questions and be able to verify their compliance.
